Apex court rejects Anara Gupta's plea
January 25, 2005
New Delhi - The Supreme Court Monday declined to interfere with an order passed
by the Jammu and Kashmir High Court restraining former Miss Jammu Anara Gupta,
accused of involvement in a porn film racket, from coming to Delhi to approach
the National Human Rights Commission.
When a bench of judges K.G. Balakrishnan and Tarun Chatterjee declined to
interfere, Anara's counsel said he was withdrawing the special leave petition
against the high court order of Dec 20.
The bench then dismissed the petition as withdrawn and asked Anara to approach
the high court for relief.
In her petition, Anara had assailed the high court decision to stay a trial
court's order allowing her to visit Delhi to seek legal remedies for alleged
"torture, humiliation and harassment" suffered at the hands of the Jammu and
Kashmir Police and "porn industry mafia".
Anara alleged the police had framed her and a forensic report had showed she
was not the girl in the porn film relied on by police.
Anara, who has been granted bail in the case, said in her petition that the
high court order amounted to house arrest and illegal confinement and subjected
her to continuous torture and harassment by police, mafia and the public.
The order violates the rights granted by the constitution and frustrated the
purpose of bail granted by the trial court, she said.
The petition said Anara, along with her mother and brother, was forcibly and
illegally taken to the police station at an odd hour Oct 24 and forced to
confess to appearing in porn films.
