Colombo Chief Magistrate and Additional District Judge Ms. Sarojini Kusala
Weerawardena sentenced Jagath Indratilleke of Kegalle for four years rigorous
imprisonment when he was found guilty on two counts, with having knowingly
harbouring an Uzbekistan woman without a visa and employing her for
prostitution.
Sentencing the accused the Judge observed that this was very serious offence
committed by the accused.
Earlier the Judge in the 39-page judgement observed that the prosecution, State
Counsel Rohana Jayasundera, had proved all the charges preferred against the
accused beyond reasonable doubt.
In the judgement also stated that the accused had been knowingly harbouring the
foreign woman and had employed her for prostitution for over a period of one
year and eight months since January 1, 2003.
The accused stated that she was not willing to leave the country therefore he
kept him in his place and that she was also suffering from a severe heart
ailment.
The Court could not believe these reasons as there was no sufficient medical
reports or evidence to prove that she was suffering from any heart ailment or
that she was not prepared to leave the country.
Refusing an application for bail in respect of the accused by Senior Defence
Counsel Kalinga Indatissa, the Judge observed that the accused was charged
under the Immigration and Emigration Act.
State Counsel Rohana Jayasundera assisted by Inspector Kumarasiri Uduwella,
OIC, CDB, Cinnamon Garden Police appeared for the prosecution.
