Quickie Muslim divorces could be on the way out
November 11, 2000
Muslim husbands in India are to lose the option of getting rid of their wives
by just saying the word "divorce" to them three times.
Authorities are introducing a marriage contract which will make Muslim men more
accountable, and give the divorced wife more rights including the matrimonial
home.
Nafia Hussein, of the New Delhi-based National Commission for Women, said:
"Until today in India a Muslim man just has to say the word divorce three times
in one sitting to his wife so long as she is also a Muslim.
"But nowhere in the Koran does it say that a man can so easily obtain a divorce
- it must be done in three sittings over a period of three months and ten days.
This has been practised in India for many hundreds of years and the women do
not know any better."
The All India Muslim Personal Law Board is finalising the Nikahnama marriage
contract which will improve the deal for divorced women, the South China
Morning Post reports.
Uzma Naheed, a member of the board, says the new ruling that the "talaq" - the
Muslim word for divorce - must be delivered over a three month period should
reduce the practice of Muslim husbands initiating their own "quickie" divorces.
